Information on the processing of personal data
Pursuant to Article 13 of Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (OJ EU L 2016 No. 119, p. 1, as amended) (“Regulation”), we hereby inform you on behalf of POK Finco sp. z o.o. that:
1. The administrator and processor of your personal data is POK Finco sp. z o.o. with its registered office in Warsaw at ul. Wincentego Rzymowskiego 34, 02-697 Warsaw; Contact details: w.cieslak@boig.pl, tel: +48 691 996 911, mailing address - address above.
2. The legal basis for the processing of your personal data is:
a. if you are a contractor:
• Article 6(1)(b) of the Regulation, i.e.: necessary for the performance of a contract to which you are party or in order to take steps at your request prior to entering into a contract;
• Article 6(1)(c) of the Regulation, i.e.: a legal obligation incumbent on the Controller related to keeping accounting books and tax records, resulting from generally applicable laws (including the Accounting Act of September 29, 1994; the Tax Ordinance Act of August 29, 1997);
• Article 6(1)(f) of the RODO, i.e.: necessity for the purposes of the legitimate interests pursued by the Controller, including ensuring continuous and uninterrupted business operations, internal administrative purposes (including service management), necessary settlements in connection with the concluded contract, establishing, pursuing or defending claims and against claims;
b. if you are a natural person representing a legal person or an organizational unit that is a contractor or taking action prior to the conclusion of a contract, as well as an employee or associate of such a legal person or unit, participating in the conclusion or performance of a contract – Article 6(1)(f) of the Regulation, i.e.: necessity for the purposes of the legitimate interests pursued by the Controller, consisting in activities related to determining the terms and conditions of the contract with the contractor and facilitating communication related to its performance, as well as determining the persons responsible for its performance and authorized to make contact within the framework of the contract.
3. Your personal data may be transferred to the following entities: entities authorized to process them on the basis of legal provisions, in particular public authorities; companies supporting our activities, i.e., IT service providers, postal/courier/transport service providers, accounting/auditing offices, shopping center managers, law firms, and other business and commercial partners cooperating in the performance of the contract, as well as entities from the BOIG Property Consulting sp. z o.o. capital group.
4. Your data will be stored for the duration of the contract and after its termination for the period necessary for tax settlements or the expiry of claims or the enforcement of securities, unless the regulations require earlier deletion of the data.
5. You have the right to request the Administrator to access your personal data, the right to rectify, delete, or limit the processing of your personal data, and the right to transfer your data. In addition, you have the right to object to the processing of your data in connection with a specific situation (this right applies, among other things, when the controller processes data for purposes arising from its legitimate interests).
6. You have the right to lodge a complaint with the supervisory authority responsible for personal data protection, which is the President of the Personal Data Protection Office, if you believe that the processing of your personal data violates the provisions of the Act of May 10, 2018 on the protection of personal data (i.e. Journal of Laws of 2019, item 1781) or the provisions of the Regulation.
7. The data provided by you will not be subject to automated decision-making and profiling.
8. Providing your personal data is a prerequisite for the conclusion and performance of the contract and for the fulfillment of the legal obligations incumbent on the Controller.
9. Depending on the circumstances of the case, we will process, among others, the following categories of your personal data: basic identification data (e.g., name and surname), contact details (e.g., telephone number, e-mail address), address details (address of employment), job title. The categories of data will be collected in accordance with the principle of adequacy, taking into account the purpose of the matter, and will result primarily from applicable law. Your personal data will come from the contractor who provided the personal data of contact representatives in the contract or from publicly available sources (e.g., website).
